Expansion of Online Court Pilot

In April 2018, and following a successful pilot, the Ministry of Justice rolled out its ‘online court pilot’ to the public.

The ‘new’ online Court was tendered a replacement of Money Claim Online and was aimed at providing a more user friendly, intuitive online platform for dispute resolution, for individuals and small businesses who are ‘acting in person’ without the assistance of legal advice.

Similarly to Money Claim Online, the Online Court service was designed to handle small claims of up to £10,000 against single defendants, but the new Court also offered its users the facility to settle their disputes online as well as recommending the use of mediation services.  Whilst subject to some scepticism during its infancy, the pilot was nevertheless regarded by many as a moderate first step in the use of technology for the resolution of lower-value claims.

On 14th January 2019, the Court’s Online Pilot was expanded to enable Defendants to submit a wider variety of responses to claims, including part admissions, part defences, defences of having already paid and offers to negotiate.  There is also the addition of Annex A which sets out the detail of the affordability calculator used by the Courts in cases where a defendant has admitted a claim (in part or full) so that parties can constructively self-assess the viability of a repayment proposal, saving further time and cost.

It is expected that there will be further expansion of the online court throughout 2019 to include claims with multiple claimants and defendants, and subsequently to those who have legal representation.
